Overview

EV-Universe, LLC (also known as EV-Universe.com),is committed to safety.  We take many steps to ensure that the products we sell are of the highest standards of safety from reputable manufacturers.  We cannot, however, be held responsible for any injury that may occur to the user through mis-use, incorrect installation, modification, or any alteration to our products. We require that each customer read, understand and agree to the terms and conditions specified herein. Our desire is to have our customers enjoy a safe experience with their electric vehicles.

 

Contract

These Terms and Conditions constitute a contract between the Customer and EV-Universe.com. By purchasing from this site you certify you are 18 years of age or older and that you agree and abide by the terms of this contract.

Safety

Customers agree to operate Product(s) purchased from EV-Universe.com in a safe manner, in accordance with the Product(s) proper use, in adherence to manufacturer's specifications and U.S Consumer Product Safety Commissions recommendations.

EV-Universe.com requires that the customer read and agree to the recommendations made by the U.S Consumer Product Safety Commission and this site, including (but not limited to) the following:

• Wear a helmet

• Wear knee and elbow protection (pads) and solid toe shoes.

• Do not ride at night

• Do not ride in traffic

• Ride on solid, dry and smooth surfaces – avoid water, dirt and other adverse road conditions

• Do not ride in adverse weather conditions (rain, high winds, etc.)

• Ensure your vehicle is maintained in accordance with the manufacturers specifications

• Vehicles are not to be ridden by anyone under the age of 18

• Products are intended for single rider use only

• Products on this site are not suitable for handicapped persons or those with diminished mental or physical abilities

• Check and adhere to local authorities riding guidelines and restrictions.

Local Laws

It is the customer's responsibility, not the seller's, to identify and obey all applicable local, state, federal and international laws in regard to the possession and use of any item purchased from EV-Universe.com. The customer agrees that the products ordered will be used in a lawful manner. The customer also agrees that the buyer is of legal age.

Insurance

The customer shall be responsible for determining and attaining insurance protection they require before purchasing Product(s) from EV-Universe.com.

Risk

The customer acknowledges and assumes the risk of any injury arising from operation of any Product(s) purchased from EV-Universe.com, whether by the customer, or by any other person who use such Product(s).

Damages

EV-Universe.com is not responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to the Product(s) sold on this Site.

EV-Universe.com shall have no obligation and the customer or user shall have no action against EV-Universe.com, and all other persons acting on their behalf, for any damages, including without limitation, incidental, consequential, special, punitive damages arising from direct or indirect injury to person or property, or any other loss, whether or not occasioned by negligence, or otherwise, on the part of EV-Universe.com.

The customer agrees to release and forever discharge EV-Universe.com and all other persons acting on their behalf, from any and all claims, actions, damages, liability, costs or expenses and attorney fees which arise out of, or are in any way connected to the buyers participation or use of Product(s) purchased from EV-Universe.com, whether or not such claims, actions, damages, liability, costs or expenses are caused by the negligence of EV-Universe.com.

The customer agrees to surrender and waive any rights to sue or exercise any legal right to seek damages from EV-Universe.com and all other persons or entities acting on their behalf.

The customer acknowledges and agrees that it shall have no claim for liability against EV-Universe.com for any misuse of any of Product(s).

Limited Liability

The maximum liability that EV-Universe.com shall have to a customer and/or a user of Product(s) purchased from EV-Universe.com is limited to any amounts actually paid to EV-Universe.com by customer. You acknowledge and agree that the limitations of liability, disclaimers of warranties and limited remedies set forth herein represent an inseparable allocation of risk that is an essential basis of the bargain between the parties.

Arbitration

This Agreement shall be governed by, construed and enforced in accordance with the laws of the State of California, as it is applied to agreements entered into and to be performed entirely with such state.
The customer and EV-Universe.com agree that any dispute hereunder will be resolved through binding arbitration in the city of San Diego, California, pursuant to the laws of the state of California. by agreeing to arbitration, customer acknowledges that he is giving up any rights he might possess to have the dispute litigated in a court or jury trial, to some or all discovery and to appeal.
